The Unlawful Detention of Citizens by Law Enforcement Agencies: A Call for Action

The recent press conference held at Koyen-Hi Kebonkwu Chambers brought to light the alarming trend of unlawful and arbitrary arrests and detentions by law enforcement agencies in Nigeria. This practice, particularly prevalent among the Nigerian Police Force and the Police Intelligence Response Team (IRT), is a serious violation of human rights and fundamental principles of justice.
*The Plight of Citizens*

The case of Buba Mohammed, arrested in Yobe State and detained in Abuja without charges, exemplifies the plight of many individuals in police custody. The denial of bail and the insistence on detaining him until his senior brother is apprehended is a clear violation of the law. This is not an isolated incident, but rather a symptom of a larger problem that requires immediate attention.
*Constitutional Rights*

Section 35 of the 1999 Constitution of Nigeria guarantees the right to personal liberty and due process. It is imperative that law enforcement agencies adhere to these provisions and bring arrested individuals before a court of competent jurisdiction within 24 to 48 hours. The failure to do so undermines the rule of law and emboldens perpetrators of human rights abuses.

The unlawful detention of citizens has severe implications for human rights, the rule of law, and national security. It erodes public trust in law enforcement agencies, creates a culture of impunity, and perpetuates human rights abuses. The government and authorities concerned must take immediate action to address this issue.

The press conference called on the government to take the following actions:

1. Investigate all allegations of unlawful detention and bring perpetrators to justice.
2. Ensure that all detainees are treated in accordance with due process.
3. Establish an independent review mechanism to monitor and oversight law enforcement agencies.
4. Audit the activities of the IRT.
